Platform: X3P – Homecare Request Platform

Campaign Reference: You may have accessed this platform via outreach campaigns such as QR codes, digital ads, brochures, referrals, or community events.

1. Purpose & Service Agreement

  • This platform helps match a care recipient with a qualified caregiver employed by X3P.
  • Submitting a request does not guarantee immediate service. Care begins only after review and payment confirmation.

2. Eligibility & Accuracy

You confirm that you are:

  • At least 18 years old, and
  • Authorized to submit this request on behalf of yourself or someone else.
  • You certify that all information is accurate and agree to be contacted by X3P via phone, SMS, email, or push notification.
  • You may not use this platform for any unlawful or fraudulent activity.

3. Campaigns, Promotions & Referrals

  • Promotional offers are time-limited and may require eligibility.
  • Only one promotion or discount may be used per household unless otherwise noted.
  • X3P may collect campaign metadata to improve outreach efforts.

4. Caregiver Responsibilities & Your Commitments

If requesting 24/7 Live-In Care, you agree to provide:

  • A private bedroom for the caregiver,
  • Reasonable sleeping accommodations, and
  • Access to meals or kitchen facilities.

Caregivers are W-2 employees of X3P and are entitled to legal protections including breaks and safe working conditions.

5. Payment Terms

  • Pay Now: via secure Stripe checkout.
  • Pay Later: receive a payment link once your request is reviewed.
  • Service is not guaranteed until payment is received.

6. Scheduling & Refund Policy

  • Requests must be submitted before the minimum advance notice for the selected care type.
  • Cancellations 24+ hours in advance: full refund. Less than 24 hours: 50% refund. Less than 12 hours or no-show: non-refundable.
  • X3P may reschedule or deny service based on staff availability.

7. Background Checks & Screening

  • All caregivers undergo background checks and qualification verification.
  • X3P screens caregivers but cannot guarantee care outcomes beyond coordination and vetting.

8. Limitation of Liability

  • X3P provides the caregiver and manages employment, but is not responsible for unforeseeable events or outcomes beyond reasonable care.
  • You agree to hold X3P harmless for damages outside its control, except where prohibited by law.

9. Dispute Resolution & Arbitration

  • Any dispute will be resolved through binding arbitration under the Federal Arbitration Act, unless you opt out within 30 days by contacting info@x3p.ai.
  • Arbitration will occur on an individual basis only. No class or representative actions are permitted.
  • If arbitration is found unenforceable, you agree to bring legal claims in the state of your residence.

10. Governing Law

  • These terms are governed by the laws of the Commonwealth of Massachusetts.
  • X3P will comply with applicable care and privacy laws of each state we serve.

11. Intellectual Property

  • All content on the X3P platform is owned by X3P and protected by law.
  • Users may not use it beyond the scope of this agreement.

12. Electronic Signature Agreement

By submitting a form with your name:

  • You agree to these Terms & Conditions,
  • You understand this constitutes a legally binding electronic signature under the E-SIGN Act and UETA, and
  • You consent to be contacted by X3P about your care request.
